Terms of Service

1. Service Description
RepXD is a medical sales intelligence platform that provides searchable access to publicly available healthcare provider data from the Centers for Medicare & Medicaid Services (CMS). The service allows medical device and pharmaceutical sales professionals to identify healthcare providers based on procedure volumes, specialties, geographic location, and other criteria.
RepXD aggregates and presents data from:
- Medicare Provider Utilization and Payment Data
- CMS Open Payments database
- NPPES National Provider Identifier Registry
This data is published by CMS and is publicly available under the Freedom of Information Act (FOIA).
2. Account Terms
To use RepXD, you must create an account. By creating an account, you agree to:
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access to your account
- Accept responsibility for all activities under your account
Each account is for a single user. Account sharing is not permitted. Team plans are available for organizations that need multiple users.
You must be at least 18 years old to create an account and use the service.
3. Subscription & Billing
Trial Period
New accounts receive a 14-day free trial with access to all features. No credit card is required to start your trial.
Subscription Plans
After your trial ends, you must select a paid subscription plan to continue using the service. Subscriptions are available on monthly and annual billing cycles.
Billing
- Subscription fees are billed in advance on a recurring basis (monthly or annually)
- All payments are processed securely through Stripe
- You authorize us to charge your payment method on file for all applicable fees
Cancellation
- You may cancel your subscription at any time from the Billing page
- Cancellation takes effect at the end of your current billing period
- You retain access to the service until your paid period expires
- No refunds are provided for partial billing periods
Price Changes
We may change our prices with at least 30 days' notice. Price changes will take effect at the start of your next billing cycle following notice.
4. Acceptable Use
You agree to use RepXD for legitimate business purposes only. The following activities are prohibited:
- Automated access: Scraping, crawling, or using bots to access or download data beyond normal use of the service
- Data resale: Redistributing, reselling, or commercially exploiting the data obtained through RepXD
- Excessive usage: Making requests that significantly exceed reasonable usage patterns
- Unauthorized access: Attempting to access accounts, systems, or data without authorization
- Credential sharing: Sharing your login credentials with others (Team plans are available for multiple users)
- Harassment: Using information obtained through RepXD to harass, spam, or send unsolicited communications
- Circumvention: Attempting to bypass rate limits, access controls, or subscription restrictions
Violation of these terms may result in immediate suspension or termination of your account.
5. Data Accuracy Disclaimer
The provider data displayed in RepXD comes from publicly available CMS databases. While we strive to present accurate and up-to-date information:
- Data is provided "as-is" without warranties of completeness, accuracy, or timeliness
- Medicare data limitations: CMS data reflects Medicare fee-for-service claims only and may not represent a provider's total practice volume
- Update frequency: CMS releases new data annually; provider information may be 12-24 months delayed
- Provider changes: Contact information, practice affiliations, and specialties may have changed since the data was published
- Not medical advice: RepXD is a business intelligence tool and does not provide medical advice or recommendations
You are responsible for independently verifying any information before taking action based on data from RepXD.
6. Intellectual Property
Our Property
RepXD, including the website, application, design, code, algorithms, and aggregated datasets, is owned by PXM Labs LLC. You may not copy, modify, distribute, or create derivative works without our written permission.
Your Content
You retain ownership of content you create within RepXD, including:
- Saved searches and search configurations
- Custom code sets
- Watchlists and notes
You grant us a limited license to store and display your content as necessary to provide the service.
Public Data
The underlying CMS data is public domain information. Our value-add is the aggregation, organization, and presentation of this data.
7. Termination
By You
You may cancel your subscription and stop using RepXD at any time. To delete your account entirely, contact support.
By Us
We may suspend or terminate your account if you:
- Violate these Terms of Service
- Engage in fraudulent or illegal activity
- Fail to pay subscription fees
- Create risk or legal exposure for us
We will make reasonable efforts to notify you before termination unless prohibited by law or where immediate action is necessary to protect the service.
Effect of Termination
Upon termination, your right to access the service ends immediately. We may delete your saved data after a reasonable retention period.
8. Limitation of Liability
To the maximum extent permitted by law:
- RepXD is provided "as is" without warranty of any kind, express or implied
- We do not warrant that the service will be uninterrupted, error-free, or secure
- We are not liable for any indirect, incidental, special, consequential, or punitive damages
- Our total liability for any claims arising from your use of the service is limited to the amount you paid us in the 12 months preceding the claim
You assume all risk for business decisions made based on information obtained through RepXD.
9. Indemnification
You agree to indemnify, defend, and hold harmless PXM Labs LLC, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use of RepXD or any data obtained through the service
- Your violation of these Terms of Service
- Your violation of any applicable laws or regulations
- Any content you submit, post, or transmit through the service
- Your infringement of any third party's intellectual property or other rights
- Any business decisions or actions taken based on information obtained through RepXD
This indemnification obligation will survive the termination of your account and these Terms.
10. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Wisconsin, without regard to its conflict of law provisions.
Any disputes arising from or relating to these Terms or your use of RepXD shall be resolved in the state or federal courts located in Wisconsin, and you consent to the personal jurisdiction of such courts.
11. Changes to Terms
We may update these Terms of Service from time to time. When we make changes:
- We will update the "Effective Date" at the top of this page
- For material changes, we will notify you by email or through the service
- Your continued use of RepXD after changes take effect constitutes acceptance of the updated terms
If you do not agree with updated terms, you should stop using the service and cancel your subscription.
